Menopause Protections Expanding Across U.S. With New 2027 Requirements

Menopause workplace protections are expanding across the United States, with new requirements set to take effect in 2027. The Menopause Education Center (MEC) has released its September 2026 Comprehensive Review of Menopause-Related Legislation in the United States, providing employers, HR leaders, and benefits teams with a centralized view of enacted laws, pending legislation, effective dates, and emerging workplace requirements.

For the first time, U.S. employers are facing explicit menopause-related workplace accommodation and anti-discrimination requirements at the state and local level. Rhode Island enacted the nation’s first state law expressly requiring reasonable workplace accommodations for menopause-related conditions in 2025. Illinois followed suit, with menopause-related workplace protections taking effect on January 1, 2027. These protections include accommodations such as flexible schedules and temperature-adjusted workspaces.

Philadelphia has also adopted protections covering menstruation, perimenopause, and menopause, which will take effect on the same date. Additional measures are moving through state legislatures, and proposed federal legislation could further expand workplace protections nationwide. For employers operating across multiple states, this results in an increasingly complex compliance landscape.

The MEC report is designed to help HR teams distinguish enacted requirements from pending legislation, identify effective dates and jurisdictions, and evaluate whether existing accommodation, anti-discrimination, and manager-training practices are keeping pace. It also includes legislative sponsor information, allowing employers, advocates, and constituents to follow proposed measures and engage directly with policymakers.
