Kahn Swick & Foti, LLC has announced a class action securities lawsuit against Beta Bionics, Inc., a company listed on the Nasdaq Global Market under the ticker BBNX. The lawsuit, filed in the United States District Court for the Central District of California, seeks to recover losses for investors who purchased or otherwise acquired Beta Bionics common stock between July 30, 2025, and February 24, 2026.

According to the lawsuit, Beta Bionics is accused of making materially false and misleading statements regarding its business, operations, and prospects. Specifically, the lawsuit alleges that the company failed to disclose critical information about its sole commercialized device, the iLet Bionic Pancreas insulin pump. The lawsuit claims that the iLet pump employed an aggressive automated dosing algorithm that malfunctioned, delivering dangerously high levels of insulin, leading to hundreds of life-threatening events requiring medical intervention and hospitalization.

The lawsuit further alleges that Beta Bionics had received thousands of related customer complaints, which it failed to investigate or timely report to the U.S. Food and Drug Administration (FDA). Additionally, the lawsuit states that the FDA Form 483 issued to Beta Bionics in June 2025 identified more than 18,000 unreported complaints, contrary to the company's previous claims that the Form 483 was limited to a minor difference in interpretation of which complaints were reportable.

Furthermore, the lawsuit claims that Beta Bionics had failed to implement meaningful corrective actions in response to the Form 483, resulting in an FDA warning letter concerning the company's quality management system, medical device reporting, and corrections and removals. The lawsuit alleges that these failures rendered the company's positive statements about its business, operations, and prospects materially misleading and lacking a reasonable basis.

Kahn Swick & Foti, LLC, a boutique securities litigation law firm, has been recognized for its work in recovering investment losses from corporate fraud or malfeasance. The firm's managing partner, Lewis Kahn, is a former Attorney General of Louisiana, bringing a wealth of legal expertise to the case.

The lawsuit highlights significant concerns about the safety and regulatory compliance of Beta Bionics' products, potentially impacting the company's reputation and stock performance. Investors are advised to seek legal counsel to understand their rights and potential remedies.
