BENSALEM, Pa., Sept. 3, 2026 /CourierPR/ -- Capricor Therapeutics, Inc. (CAPR) shareholders who suffered significant financial losses following a series of alleged misrepresentations by the company have been given an opportunity to lead a securities fraud class action lawsuit, according to a statement from The Law Offices of Howard G. Smith.

The lawsuit alleges that between December 17, 2025, and July 26, 2026, Capricor Therapeutics, Inc. made materially false and/or misleading statements and failed to disclose material adverse information about the company's business, operations, and prospects. Specifically, the complaint claims that the company failed to disclose several key pieces of information:

1. The company had made changes to the pre-specified statistical analysis plan used to analyze clinical data for Deramiocel. 2. The U.S. Food and Drug Administration (FDA) had not approved these changes before the company resubmitted its Biologics License Application (BLA). 3. There was a significant risk that the FDA could conclude the clinical results did not provide substantial evidence of Deramiocel's effectiveness for the treatment of Duchenne muscular dystrophy. 4. As a result of these undisclosed risks, there was a substantial risk to the regulatory approval of Deramiocel. 5. The company's positive statements about its business, operations, and prospects were materially misleading and lacked a reasonable basis.

"Shareholders who have experienced significant financial harm as a result of these alleged misrepresentations have the opportunity to take action and potentially recover their losses," said Howard G. Smith, Esquire, in a statement to the press.

If interested, investors can contact the law firm to discuss their legal rights. To be part of the class action, investors need not take any immediate action, but they may choose to retain their own counsel or remain an absent member of the class action.

"This class action provides a critical opportunity for shareholders to seek justice and potentially recover their financial losses," added Smith.
