Liquidia Corporation has reached a global settlement with United Therapeutics Corporation, resolving all pending litigation between the two companies. The agreement ensures uninterrupted access to YUTREPIA® (treprostinil) inhalation powder for patients with pulmonary arterial hypertension (PAH).
According to the terms of the settlement, Liquidia will make a net payment of $380.7 million to United Therapeutics in multiple installments over the next two years. Specifically, Liquidia will pay $175 million within 30 business days, followed by two equal installments of $72.7 million each, due on January 31, 2027, and April 30, 2027.
The settlement also includes the removal of the PH-ILD indication from YUTREPIA’s label, as Liquidia has submitted a supplement to the U.S. Food and Drug Administration (FDA) to reflect this change. Additionally, Liquidia has agreed not to appeal the court’s ruling that claims 1 and 14 of U.S. Patent No. 11,826,327 (the ’327 patent) are valid and infringed by Liquidia. The settlement covers six ongoing lawsuits, including those related to alleged infringement of U.S. Patent No. 11,357,782, U.S. Patent No. 10,898,494, and U.S. Patent No. 11,826,327.
Liquidia’s financial position remains strong, with $222.7 million in preliminary, unaudited third-quarter 2026 YUTREPIA net product sales, contributing to a total cash and cash equivalents balance of $396.1 million as of September 30, 2026. The company plans to use these funds to advance its YUTREPIA and L606 clinical programs as previously outlined.
The settlement agreement does not extend to indications other than PAH or to new treprostinil-containing products. United Therapeutics may still assert patents against Liquidia’s development programs or future products. Liquidia will continue to focus on growing the YUTREPIA brand and exploring new indications, including systemic sclerosis-associated Raynaud’s phenomenon (SSc-RP) and pulmonary hypertension associated with chronic obstructive pulmonary disease (PH-COPD).
Liquidia will provide a broader update on YUTREPIA’s performance, its financial position, and its pipeline priorities during its third-quarter 2026 earnings call in November.
