Deutsche Finance Group sues Bavarian pension group over real estate losses

Deutsche Finance America LLC and DF Deutsche Finance Holding AG, operating as Deutsche Finance Group, have filed a lawsuit against Bayerische Versorgungskammer (BVK) in Delaware State Superior Court. The complaint alleges that BVK, Germany's largest public-law pension group, mismanaged a nearly $2 billion U.S. real estate portfolio and then wrongly blamed Deutsche Finance Group for losses it had itself caused.
The lawsuit, which includes five claims, breach of contract, defamation, deceptive trade practices, and tortious interference with both contract and prospective business relations, aims to hold BVK legally accountable for its actions. Deutsche Finance Group claims that BVK not only oversaw the investment decisions but also took an active role in managing the properties, contrary to its role as a passive institutional investor.
According to the complaint, BVK invested approximately $2 billion in U.S. real estate projects across California, Illinois, Florida, and New York over a decade ago. The firm asserts that BVK exceeded its boundaries by selecting properties, approving investments, negotiating fees, and making decisions on individual property levels. When the U.S. commercial real estate market began to soften in 2020, the complaint states that BVK failed to take necessary actions, contributing to losses estimated at about €853 million (approximately $988 million) across its holdings.
Rather than accepting responsibility, the lawsuit alleges that BVK launched a public relations campaign to falsely shift blame for the losses to Deutsche Finance Group. This included making false statements to influential German media, regulatory authorities, and the Bavarian Parliament. For instance, BVK publicly claimed that Deutsche Finance Group was responsible for selecting underperforming investments and the resulting losses, when in fact the blame lay with BVK.
The complaint also highlights how BVK used its financial leverage to pressure Deutsche Finance Group. In December 2025, BVK demanded that Deutsche Finance Group exit its management role at the Transamerica Pyramid in San Francisco "with immediate effect and without receiving any compensation payment." Despite this, BVK paid a co-manager on the same project more than $45 million in comparable fees. BVK also withheld more than $31 million in fees that were contractually guaranteed to Deutsche Finance Group.
Deutsche Finance Group is seeking compensatory damages to be determined at a jury trial. The firm is represented by the U.S. law firm Quinn Emanuel Urquhart & Sullivan, LLP.
